What You Can Expect From the Bankruptcy Process
- Regardless of what form of bankruptcy you file for, the process will begin with a free initial consultation. Once you retain Erick Nunemaker as your counsel, he will provide you with an intake packet to work through. He will help you fill out the documents, which includes identifying all your property, gathering financial data, and identifying any other issues specific to your case
- He will determine whether Chapter 7 or Chapter 13 is the right option for you. Then he will draft all necessary paperwork, which you will need to sign before the process starts. After you sign, your bankruptcy petition could be filed in as little as 24 hours. As soon as you file, by law, harassing phone calls from creditors must stop. If a creditor does contact you after filing bankruptcy, direct them to your attorney.
- Before filing bankruptcy you will have to complete a creditor counseling course. After you file bankruptcy, but before you receive your discharge, you will have to complete a financial management class.
- Within 40 days of filing for bankruptcy, the meeting of creditors will take place. The primary purpose of this meeting is to verify the accuracy of the information contained in the documents you and your attorney filed with the court. If creditors object to any of the debt being discharged in a Chapter 7 filing, this will be addressed in subsequent hearings. In a Chapter 13 filing, your payment plan will be discussed during this meeting. If there are no objections to the plan, you will start making payments according to the plan shortly after this meeting.
- In a Chapter 7, your debt will be discharged about 75 days after the meeting of creditors. In a Chapter 13, your will receive your discharge after you make your final payment according to the payment plan set up by the court.
